People often put off making a will or trust or creating advance healthcare directives like a designation of healthcare surrogate or a living will. No one wants to think about their own mortality, and it’s easy enough in our busy lives to just put the whole matter out of our heads. But we know that’s irresponsible and that estate planning is essential to protect ourselves and our families in the event of a serious injury, illness or death.

Once we finally break down and do our estate planning, it’s a great relief to have a completed set of documents – will, trust, power of attorney – and know our family is protected. Now, the estate plan can be put in a drawer or on a shelf, locked in the safety deposit box or given to the family lawyer and never looked at again, right?

But estate planning should not be a one-time event.

Life and family never stop changing. Long after you make your will, there will be births, deaths, marriages, divorces, remarriages, more kids, step kids and blended families. Your needs change: family needs, personal needs, retirement goals. Desires change as well; your attitudes toward family members and charities you included in your will might change for better or worse, and the terms of your will no longer reflect your current feelings. Tax laws change too. Every year Congress tinkers with the tax code, and many of these changes can affect the way you structured your estate plan. Whether or not you need to worry about the estate tax or whether you created your estate plan in the most tax-advantaged manner can change over time, and you need to be able to review your plan and respond accordingly.
